SPECIFICS OF PROTECTION OF LAWYERS’ RIGHTS AGAINST VIOLATIONS BY THEIR CLIENTS

Advocate of the Collegium of Advocates of the City of Moscow «Vasha Zashchita», Postgraduate Student of the Department of Criminal Law Disciplines and Forensic Expert Activity of Pyatigorsk State University Abstract: The article examines the specifics of protecting attorneys’ rights against violations by their clients. The relevance of the study is determined by the increasing number of cases involving infringement of attorneys’ professional rights through breach of contractual obligations, filing of unfounded complaints with disciplinary bodies, and dissemination of false information about attorneys’ activities. The purpose of the study is to identify legal mechanisms for the protection of attorneys and to develop recommendations for improving legislation. Formal-legal, comparative-legal, and empirical methods were applied. The norms of the Federal Law «On Advocacy and the Legal Profession in the Russian Federation», the Code of Professional Ethics of Attorneys, judicial practice of the Supreme Court and the Constitutional Court of the Russian Federation, as well as foreign experience were analyzed. Proposals for improving legal guarantees for the protection of attorneys were formulated.
